This Privacy Policy governs the manner in which Walltek Mechanical Inc. (the “Company” or “Walltek”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the Walltek.ca website (“Site”). This privacy policy applies to the Site and all products and services offered by Walltek Mechanical Inc. For the purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at Walltek.ca. The terms “we,” “us,” and “our,” refer to the Company. PERSONAL IDENTIFICATION INFORMATION

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or legal guardian, we will delete that information as soon as possible. AGREEMENT BETWEEN consUmER AND WALLTEK

The Walltek website is comprised of various web pages operated by Walltek Mechanical Inc. (the “Company” or “Walltek”). DELIVERY

For all items sold and shipped by Walltek, delivery is subject to warehouse availability. Out of stock items will be shipped as soon as possible, upon arrival from the manufacturer/publisher. If an item is not in stock at the time you place your order, we will notify you. Please note we do not ship on Sundays.

Items offered on in-store and on our website are only available for delivery to addresses in Toronto, ON. We also accept orders from international customers who are shipping to addresses in Toronto, ON only. Any shipments outside of Toronto, ON are not available at this time.

Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars.

Any disputes arising out of or relating to the use of the Terms, the Privacy Policy, use of our website or to any products or services sold or distributed by Walltek or through Walltek.ca will be resolved in accordance with the laws of the Province of Ontario without regard to its conflict of law rules. Any disputes, actions or proceedings relating to the Terms or your access to or use of our website must be brought before the courts of the Province of Ontario in the City of Toronto, Ontario and you irrevocably consent to the exclusive jurisdiction and venue of such courts.

SEVERABILITY

If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.

RETURNS & EXCHANGES

RETURNS

We accept returns on items purchased in-store or online. You can return unopened items in the original condition and packaging within 10 days of your purchase with original receipt or proof of purchase. If 10 days or more have passed since your purchase, we cannot offer you a refund or an exchange.

Upon receipt of the returned item, we will fully examine it and notify you via email, within a reasonable period of time, whether you are entitled to a return. If you are entitled to a return, we will refund your purchase price and a credit will automatically be applied to your original method of payment. A restocking fee of up to 20% of the purchase price may apply to your returned item. This amount is deducted from the total return credit.

Only regular priced items may be refunded. Sale items are non-refundable.

EXCHANGES

We only exchange goods if they are defective or damaged. In circumstances where you consider that a product is defective, you should promptly contact us at info@walltek.ca with details of the product and the defect. You can send the item you consider defective to:

Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a replacement as a result of the defect. If you are eligible, we will send you a replacement product.

Some items are non-refundable and non-exchangeable. These include:

Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. We do not guarantee that we will receive your returned item. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

WARRANTY POLICIES

We will honor the manufacture warranty of our suppliers. Additional costs may apply to service and parts.

GENERAL TERMS AND CONDITIONS

1. It is understood and agreed that Walltek’s obligation relates solely to the specific protection system purchased herein and that Walltek is in no way obligated to maintain, repair, service, operate or assure the operation of ant device or devices or pre rough-in’s of equipment of customer or others not done by Walltek.

2. After the expiration of the warranty period Walltek will, if requested, provide the customer with repairs and parts replacement the equipment at Walltek prevailing prices and terms at the time.

3. Warranty or maintenance service will be furnished by Walltek during its normal working hours. Monday through Friday except holidays.

4. Taxes, municipal charges: In addition to the charges included herein, the customer agrees to pay any taxes, fees, levies or charges relating to the installation of services provided under this agreement which are authorized or imposed by any government body.

5. Walltek may obtain from a consumer Reporting Agency and others, personal and credit information respecting the customer.

6. Assignment: This agreement is not assignable by either party except upon written consent of the other party first being obtained.

7. Verbal: There are no verbal understanding changing or modifying any of the terms of this Agreement.

8. Approval: This agreement is not binding unless approved by the manager of Walltek. In the event of failure of approval as aforesaid, the only liability of Walltek shall be to return to the customer the amount if any paid to Walltek upon signing of this agreement.

9. If the customer fails to make any payments hereunder as and when the same becomes due and payable or shall breach any of the covenants and obligations on the customer’s part contained herein or if the customer shall become bankrupt or make and assignment for the benefit of creditors or f the customer shall vacate the premises then in any of these cases. All amounts payable hereunder until the expiration of the currents term of the Agreement shall immediately become due and payable, and Walltek may at its option and without prejudice to such other rights as it may then have, enter into the premises and remove the systems; and such removal shall not in any way affect the customer’s obligation to pay as herein set out.

10. The customer shall be responsible for all damages to any system Walltek installed during the continuance of this Agreement for any cause whatsoever and shall pay to Walltek, upon receipt of invoice the costs of repairing and such damages or further replacement of any parts of the systems installed which may be damaged.

11. The Agreement constitutes the entire Agreement between the customer and Walltek and no other representation or statements not contained in the Agreement shall be binding upon Walltek as a warranty or otherwise. The Foregoing terms and conditions shall prevail not withstanding any variance with terms and conditions of ny order submitted by the customer. The customer acknowledges having read all terms and conditions contained herein and agrees to same.

12. It is the buyer’s responsibility to ensure that the appliances in this contract are installed by licensed technician as per local codes and manufacturer’s installation instructions.
